    ...that the error only covered the first three days of voting? That's what West's demand for a recount of the other days hinges upon.  Like it or not, our legal system looks at the legitimacy of the claim rather that the legitimacy of the claimant.

      and like it or not, what the St Lucie Board did opens up what appears to be a valid claim.

      The supervisor of elections in St Lucie Cty always has the power before the canvassing must be filed-12 days after the election-to correct errors in the initial tabulation. Every supervisor has to be able to do this since votes can always be misplaced or erroneously entered. The ballots are always retained in case of an election challenge. Here what happened is that the attorney for the supervisor stupidly let them notice this thing as a recount as opposed to what it was- a rechecking of the initial canvas tabulation. It was this error- which the supervisor tried to correct - that has caused the major portion of the problem. By the error West has been able to scream about being denied a "fair" recount when he had no right to one in the first place. He can always challenge the election once the canvas is sent to the local canvassing commission.

        at the courthouse.  The judge who drew this case will absolutely have heard both sides of this, as that's a really small legal community in Ft. Pierce.  

        I'm really not worried about this race at this point.  Vaughn is not going to overlook the law and the math for partisan purposes -- not if he's still at heart the same guy he was in high school.

      Per local news, the problem was with the memory cartridges for certain early voting days. This was apparently a statewide problem, not just St. Lucie County, and Tallahassee (Rick Scott's crew) directed all counties to recheck those days.

      As for the troubles election night,

      Controversy continued as returns trickled in on election night and a slender West lead turned into a small Murphy advantage after a batch of early votes from St. Lucie County was tallied after midnight.

      St. Lucie County Elections Supervisor Gertrude Walker said the votes came in late because tabulating machines had been unable to read some of the electronic memory cartridges containing ballots from early voting sites. Those ballots were fed through scanners at the elections office later in the evening, Walker said.

      I saw Susan Boucher, SoE for Palm Beach Co. (also involved in the recount for Murphy/West race) ranting on WPBF that it is the State of Florida's responsiblity to find and provide voting systems for the counties, so if anyone wants to complain about crappy results on crappy equipment, please direct those complaints to the State, not the counties.
