    cloture vote, you can't stop a "filibuster" regardless of whether someone is actually speaking or not. The threat/promise of the delay is all that is necessary; once cloture fails, you cannot proceed on that bill. So while you are technically correct in that filibusters themselves haven't changed, in practice that distinction becomes meaningless when the cloture rule is in effect. And to invoke cloture, Reid has needed 60 votes in the Senate since he became leader.
