    And you see all the senators up on the podium joking and laughing.  The democrats just screwed themselves!  The republicans are gonna continue threatening the nuclear option every time the dems try to speak up.  its just sick!

      Now we get three really awful judges, but the upshot is that Frist didn't deliver the whole package to Dobson.  There is no way Frist can declare total victory on this.  The Dems can't either.

      It's like a union contract: if both sides come away bitching about it, maybe that's a good thing.

      All in all, I think we made out well.  There was no guarantee we'd make it out of tomorrow this well.

        Whacko to whacko - the balance doesn't change except by age.  The real worry comes if one of the good judges falls ill.

        the Rethugs have rolled the the Dems again.  When the time comes to fill an SC vacancy this whole deal will be down the toilet.  Fer cryin' out loud, how many times do the Rethugs have to proof they don't give a shit about deals, rules or fair play.  Suckers again and I am sick of it.

          If they nominate an extreme right winger, then Demos filibuster him just like it says they can in the agreement. At worst the nuclear option comes up and we are no worse off then we are right now.

            really? seems to me the threat of the nuclear option gets hung over the dems heads again only next time the stakes will be MUCH, MUCH higher with the chief justice of the SCOTUS scenario... i.e. the rethugs and clownservative media will easily resort to: "Look! the dems are threatening to close down the government AND we don't have a chief justice because THEY are blocking him!"

            THIS FIASCO HAS ALWAYS BEEN ABOUT THE NEW CHIEF JUSTICE OF THE SCOTUS. the other judges are small fry in comparison.

            christ, this should be a no brainer. the dems won ZERO today, they are merely delaying the embarrasing and inevitable bending over (again) for the rethugs.

              Superpole is right.  We're no worse off?  Well, actually we are because the Repubs got some of their judges without having to go nuclear and now we can only use the filibuster if the situation is "extraordinary" AND IF THE REPUBLICANS AGREE.  We've also now just set a precedent that Priscilla Owens is not extraordinary so anything goes.

              They got judges in the hand.  We got vague promises in the bush -- from known liars.  And those vague promises are contingent on the liars' acquiescence.

                how IRONIC that now the wimpy dems have to ask permisssion of the rethugs to employ the filibuster "next time".

                hmmm, I didn't see the Neoclowns ask permission from the UNSC for their illegal and bloody invasion/occupation of Iraq.

          To claim victory on this is wishful thinking, and the first clue that perhaps someone has been in a coma the past few years (sorry Kos, but really, this is a DINO sell-out). The second Bush puts someone hideous in for SC and the Dems hint at filibuster, the Repubs will scream foul, the deal will cave and the nuclear option will be launched. In the meantime, Owens and Brown are seated and making up laws for corporations as they wish.

          Outside of pissing off Dobson, we won nothing on this. Worse, we lost the ability to actually show some backbone and have something huge to run on in 2006.

            How is that worse that the alternatives,

            We have a vote
            A) Demos lose, we now have no way of preventing a wacko SC nominee, this is worse than the deal

            B) Demos win, there's nothing stopping the Repubs from trying a nuclear option again after having more time to put more pressure on the Repubs that voted against the nuclear option. No worse than the deal.

            There is no way we are worse off by doing this deal,

        That statement isn't true by a longshot. Since the Senators who cut the deal said that they wouldn't support a filibuster except under "extraordinary" circumstances. I can guarantee you that if Gonzalez or someone worse than him comes up that either the Democrats who signed on to this deal will refuse to support a filibuster or God's Own Party will use the nuclear option. This deal meant nothing.

      We need to keep up the pressure on this one, The Repubs are using blackmail and the dems are falling right into their dangerous trap..
