    There was a shootout one block from my apartment two nights ago, and all I could think about was: why can't we ban guns?  If criminals and drug dealers had to rely on old-school weapons, maybe they wouldn't be so brazen and terrorize communities as they do now.  I think I'd feel more "free" in that case than having some 2nd Amendment so a bunch of people can go hunting.

      •  Second Amendment used to be considered (0+ / 0-)

        to be just about regulated militias, not anyone who wants to own a gun.  The NRA knew this and the courts knew this.  In '08 and '10, SCOTUS decided by the usual 5-4 margin of radical rightwing activists that the 2ns Amendment conferred a general right to own guns.  That made the right to own a handgun.  So this is just a vote away from being reversed to a more sane position, just like so many of those other 5-4's.  The 2nd doesn't have to go, just be re-evaluated in the light that it was seen for many years before these activist decisions.

          Once the Supremes have ruled, it's very hard to get subsequent Justices to overrule.

            It's not that hard at all.  It's purely about respect for precedence, and some judges don't have much of that at all.  Look at Scalia and others who would be stoked to overturn Roe.  So, it happens.  Hopefully wisely and incrementally.

            Really, if the recent, narrow decisions finding a general 2nd are overturned, I hope the pro-gun folks don't go all Randall Terry and freak out.  Guns aren't the be-all, end-all, without which we're all screwed and the Constitution is just a piece of paper.  As with homicide statistics, look to other First-World democracies for comparison.  They get by OK.  We're not that different.

            And the 2nd isn't self-evident in its meaning.  It has to be interpreted in good faith (knowing reasonable people disagree), ideally with some kind of compromise emanating from the Court, and, I gotta say, pragmatically.  Much like Roe.
