  •  Try that there's virtually NO information (24+ / 0-)

about the sister.  Whether she was present.  Whether she attempted to defend her.  Whether she called 911.  Whether she had any knowledge whatsoever that her brother hated her girlfriend.  In fact, whether the brother even hated the girlfriend.  It's Mallory's mother, who wasn't there and has no actual knowledge of the facts, saying no one tried to help her.  It seems the family is a violent one, and virtually no facts about how or why the beating started or what happened before or during it are provided to tell us  whether this was indeed a hate crime or what others did.

An awfully lot of conclusions are being jumped to about the horrible incident based on virtually no facts.

Well, except that pipe wrench to the head last year. I guess that could have been an act of endearment. . .

      •  People are beaten all the time when a hate (0+ / 0-)

crime is not involved.  Remember, the son was beaten by the father.

We two facts here:  1.  the brother had previously physically attached Mallory.  2.  Mallory is a lesbian.

The questions are:  are those two  facts NECESSARILY related?  If not, do we have other facts to support the theory that they are?

The answer to the first question is no.  People physically attack both homosexuals and heterosexuals quite frequently for reasons having nothing to do with their sexual orientation.

The answer to the second question needs more facts to answer.  Such as:  Has the brother made statements or threats that included any kind of hate language?  Has the brother attacked other people; if so, did those acts involved a hate crime or does he just frequently go around attacking people?  Does the brother have some kind of mental or emotional problem that results in random, unprovoked physical attacks against others? What was occurring just prior to the attack?  Were he and Mallory arguing about whether chocolate cake or yellow cake was better or were they fighting about Mallory's sexual orientation or did the attack occur without any kind of fight?

A hate crime has very specific requirements.  This diary did not provide nearly enough facts to determine whether this situation involved one, even though there's a high probability it did.  And it certainly does not contain enough facts to be reaching conclusions about the guilt of the girlfriend.
