  •  Would be unconstitutional anyway (5+ / 0-)

As it is, Article III of the Wisconsin Constitution has it that if you are a US citizen, a resident of Wisconsin, over 18 and do not fall into a very limited number of categories that the legislature is allowed to exclude you on (i.e. being an on-paper felon or adjudged incompetent by a court or no other grounds whatsoever), you are an elector of Wisconsin.

Removing same-day registration while leaving the current you-have-to-be-registered-in-order-to-vote statute on the books would be adding an additional qualifier that the legislature does not have the authority to add, namely "... and has registered prior to election day".

We have two very recent rulings that put the legislature in its place on this front, namely its attempts to add "... and has a photo ID" as a condition.

Fake candidates nominated by the GOP for the recalls: 6 out of 7. Fake signatures on the recall petitions: 4 out of 1,860,283.
