    And just because this screwed up Supreme Court might take that position by a bare majority, that does not mean that those laws are actually unconstitutional.

      if a SCOTUS majority declared something unconstitutional, it was unconstitutional.  The only option then is to change the constitution, or wait for some SCOTUS personnel turnover.

        It is a defeatist attitude to simply accept that because an errant Supreme Court declares something unconstitutional that it actually is.

        But my question was specific - "On what grounds would this be unconstitutional?"  Please cite the specific parts of the Constitution that would suggest that these kinds of laws might be found to be unconstitutional.  

        The irony of my question is that if there were a constitutional '"remedy" for the hardships of entities like Clear Channel who wanted to expand their conglomerate, I am pretty sure that the "Constitutional Scholars" in the conservative ranks would have figured that out a long, long time ago instead of having to work on Congress and Presidents to give them more latitude.

      but I fear we will remain Democrats.
