  •  Take Back the Second Amendment (5+ / 0-)

The gun cult uses the Second Amendment to legitimize their gun lust.  We shouldn't allow them that advantage.  The Second Amendment never was intended to allow personal possession of guns and any gun debate we have should make that point.  Rational Americans have no obligation to respect "constitutional rights" the gun cult don't have.

SCOTUS has foreclosed any other remedy.

      •  That remains to be seen. (0+ / 0-)

The Second Amendment has been perverted by the gun cult to support their gun lust. A reawakened gun control debate very well might find it means something else entirely. Recall, it did not make gun possession a constitutional right until just a few years ago when the Supreme Court said it did. As we have come to see, though, the majority of this Court are little more than stooges for right wing ideologues. In a few years that could change.

Note also, John Roberts willingness to change his position on PPACA to suit the political mood of the country.  Had he voted with the rest of the conservatives, he would have seriously endangered the integrity of the Court.  A gun control debate focused on redefining the Second Amendment could have the same effect on his, or another justice's, opinion in a future case.

    •  Original intent (0+ / 0-)

We've got a different country now with different needs, we can and should make laws to address the world of today. But if you want to talk original intent, check out Joyce Lee Malcolm's 1996 book tracing the centuries of English law that led up to the 2d. Amendment.

      •  The Nature of the Militia (0+ / 0-)

The Second Amendment is concerned with ensuring the security of the country is in the hands of a militia.  It's meaning, then, rests on the understanding of the word "militia."  Is a militia to be understood as a bunch of guys with their own guns, as the NRA would like us to believe, or is a "militia" an army of common citizens as commentators such as Alexander Hamilton believed?
