        the Governor appoints the Senator (like Paterson did with Gillibrand). There is no special election; the appointed Senator runs in the next regularly scheduled election to fill out the term.  There is no law stating that the new Senator must be of the same party as the outgoing Senator.  In 1968, when RFK was assassinated, Gov. Rockefeller appointed his fellow Republican Charles Goodell (father of the current NFL Commissioner) to fill the seat.
