     In fact, George Washington, looking back on the Constitutional Convention (which he presided over), said that it was an illegal gathering under the Articles of Confederation.
      The justification was a practical one however. The house (the new U.S. government) was on fire, and if they had any hope of success, the fire needed to be put out, a concept that had universal agreement.

      But I suppose that if we had geniuses like Antonin Scalia and Samuel Alito in charge at that time, they would have let the house burn down.
