    An individual may not be appointed as Secretary of Defense within seven years (the National Security Act of 1947 originally required an interval of ten years after relief from active duty, which was reduced to seven years by Sec. 903(a) of the 2008 National Defense Authorization Act) after relief from active duty as a commissioned officer of a regular component of an armed force. As Shinseki retired in 2003, there's no longer a legal impediment to nominate him as SecDef.
