    I hadn't read your account of the Standing Bear case before. I was aware that the US government specifically declined to appeal the lower courts decision because they were afraid of what the Supreme Court might do.

    The account I read alleged that General Crook himself colluded with a progressive newspaper editor in Nebraska to bring the habeas corpus action against the government, in the person of... General Crook. Crook arranged to have himself sued in that instance, and spent much of his post-military career advocating for the rights of his Indian former enemies.
