    in this. None. There is no threat. There is a statement of desire, like wish-fulfillment.

    Sadly, I think many will fail to grasp the distinction here.

    I hadn't heard about this murder in Manteca, but it comes as no surprise to me.

      which is intentional, and yet, is still protected because it is not an imminent threat, because it was conditional on "if gun control is implemented."

        he'd be in custody. The fact that he's not speaks volumes. And yes, I see a big distinction between his videos, which could incite at least, and this facebook post where the person makes a statement that has no human subject committing the act of violence expressed. Yeager says "I" and then follows this by that conditional, modal verb which is contingent, as you say, and he's doing the action. This facebook statement not only doesn't contain any incitement, it also simply expresses something sans human subject -- the bullets are just "in" the cops' head. It doesn't say who puts them there. For all anyone knows, it could as easily be a protest against those who would kill the cop, and a general expression of fear that the cop would be shot. I'm not saying that's likely, but that's the text on the page; it allows for that and CANNOT be interpreted clearly as a threat due to that alone.

      certain communities.

      And I just don't "get" all the comments comparing the supposed "threat" here to the Yeager video diaries. The former is a 'throw-away' expression of anger in a normally anonymous context amid literally millions of other comments over all the videos on that site. The latter is a specific individual implying he's going to start shooting people and then following up with a video stating that he'd "raised an army" and that he doesn't advocate revolution "unless it's necessary, and it's not necessary--yet."

      One of these is not like the other. And it's still unlikely Yeager will be prosecuted--which is as stark a picture of different rules we have different classes/groups of citizens as anything I've seen recently.
