    At best the policeman imagined one in his hand.  No weapon (knife or gun) was found on him or near him.  The closest weapon was a knife found in the flatbed of the truck.

      He saw a weapon on the dash camera footage in the Mr. Duenez's right hand, and there was a sheath for the knife on his belt. I don't know whether I see that, but that's what they claim.

      This is the DA's memorandum to the Police Chief which includes the conclusions of the photo analyst. They really don't do themselves any favors by not releasing the highest quality PDF's. I can see why the DA didn't charge, but I think that was a bad call.

      For what it's worth, I feel that the family is due their day in court rather than having this case play out in the heavily edited and pixelated court of public opinion. They also should have the right to all available evidence and to have be reviewed by an independent expert.

      I am also not a fan of the way the police handled the crime scene. The shooter should not have been recovering evidence or moving the suspect after another officer had arrived on scene.

        Thanks for the link.  I've looked at the whole thing.  The ridiculous assertion that the knife they claim to be in his hand ended up in the flatbed of the truck because "we have no idea why other than it had to because he had a knife and it wasn't found anywhere near the body" pretty much says it all.

        The only thing that one can see as far as I can tell are some shadows that could be pretty much anything.  The fact that no knife was found anywhere plausible in relation to the body is proof beyond a reasonable doubt that he had no knife in his hand.  IMHO.

        Now that I understand how it all came down I find it even more amazing.  The officer fired 11 shots when he knew that there two innocents in the truck almost in the line of fire, either of which could easily have been hit by a ricochet or by bad aim (the first or second shot totally missed and hit the soffit of the roof of the house!)
