    themselves rather than bothering with having people vote for President on the ballot?  In other words, pass a law saying "in 2016 this state's electoral votes go to the Republic candidate".

      But they can pass a law saying that Virginia's state legislature will select the electors in 2016. That would be legal by Federal law.

        in advance would be perfectly legal as long as it was only done for that one election and not something like "this state's electors will be X, Y, and Z for the next 20 years".

          Yeah, it would be legal. Though the argument might be that for equal protection to be satisfied, the legislature must be through one election itself before passing that law (e.g. Legislature must be subject to elections before picking Presidential electors). Otherwise, yeah, I think it's "fine".

          •  That might not necessarily be required as a (0+ / 0-)

            new legislature could always change their mind and set it back.  Still, they would probably do it that way just to avoid some legal challenges and there really wouldn't be any downside as they would probably easily be voted out if they pulled a stunt like that.
