  •  Actually no, Aaron Burr created the filibuster in (7+ / 0-)

    1801 when he incorrectly ruled the motion to proceed in order.  It had nothing to do with the the Constitution, the Senate or the Founders.

    It was all about Burr creating chaos for Jefferson in hopes of running against him in 1804 to finish the coup he tried in 1800.  

    IOW, the filibuster is merely a posionous viper left by a traitor, still killing the patient long after the traitor was gone.

    Understood that way, you can really only ask WTF did we keep the thing?

      I said the SENATE was designed for dysfunction. I know the filibuster rule is not in the Constitution.

      •  Oh, well I'd say dysfunction, just slower function (0+ / 0-)

        and more rural, and originally completely the creature of the property and political elites (pre-17th Amendment).

        W/o the filibuster, the Senate would function exactly as ntended: as the cooling pot but not the pot where things go to die.
