If you buy one from a private seller-like through a classified ad site, or from someone on a gun forum, in most states it's perfectly legal and doesn't require any background check, or even a record of the sale. You do need to buy it from a seller within your own state though.

If you are buying from a Federally Licenced Firearm Dealer though-as most online shops are, including the one this diary is talking about-you are subject to a background check (which can be done over the phone) and if you pass, they ship the gun(s) to a licensed dealer in your area where you then pick it up in person.

    •  I have purchased a firearm online... (0+ / 0-)

...and the background check was done in-person when I went to pick up the firearm, rather than on the phone.

Well, the person conducting the check did it on the phone, of course, but picture ID was required, as with any other purchase.  I asked the person conducting the check about the procedure (I was curious, never having bought a firearm in exactly that way).

Had there been a hold put on the purchase (as often happens when the system is busy, or if you happen to have a common name, for instance), he would have held the firearm on the premises until it was cleared.

Had the sale been completely blocked, he would have simply shipped it back to the seller, and my purchase price would have to be refunded by that seller.  He was unsure about who would have gotten stuck with the shipping costs.

Just sharing my experience of the process...

Yes, I often dress as a pirate. Your point?
