    anti-discrimination would be a tough sell in some of the states that have discussed rigging the game.

    Voting Rights Act was clear that is was to stop discrimination, but some of the states would not be subjected to this notion.

    •  VRA involves racial discrimination (4+ / 0-)

      This is political vote dilution, which may be challenged as an Equal Protection violation.  

      •  And geographic, and frankly racial too, but in a (0+ / 0-)

        way that may not be VRA actionable.  After all, if the CDs themselves survive VRA, then the question is does VRA reach to EV weighting which takes the VRA-acceptable C/districting and makes it the vehicle for a discriminatory distriution (by dilution) of EVs?

        I have no idea if the VRA even reaches to the EC.
