between "corporate personhood" and the ACA tax on medical devices and the layoffs.

Corporate personhood has roots back to 1886 and the Southern Pacific v Santa Clara Supreme Court case. There are now hundreds of laws and court cases at the federal and state level dealing with this issue so it would be difficult to unwind. And corporations need to have status in court and the ability to own real and personal property so they will always have some of the same rights as people. The other challenge is that it is states that give corporations their rights and corporations incorporate where they like the state laws. Half of the public companies in the US are incorporated in Delaware.

One of the more interesting issues regarding corporate personhood is that the issue became the source of more conversation on the internet in the aftermath of Citizens United but corporate personhood wasn't even an issue in the case.

    "let's talk about that"

    •  That's too narrow a focus and relies on (0+ / 0-)

contrivances that include money as speech and finds a freedom to listen rather than a freedom of speech in the 1st amendment with no consideration of the source. Speech is a human function and we really do need to move away from both treating people as property and property as people.

Others have simply gotten old. I prefer to think I've been tempered by time.

re: Southern Pacific v Santa Clara   In that decision, the court never ruled on the constitutionality of corporate personhood.  Rather it conveyed to the court reporter the notion that all of the justices agreed that the 14th amendment was applicable, in the situation before the court.
The court specifically sought to avoid ruling on the constitutionality in the case before them.

Planning a vacation or convention in Arizona? Come to Palm Springs instead! Same desert weather, none of the smog, traffic and bigotry.
