    It can take up to 2-5 years for a case to go to trial.  The DA can close the case at any time (as soon as the heat dies down perhaps).  Even if the guy is convicted (wanna bet on a hung jury?) his right to appeal means he can stay out during the appeals process.  Also a hung jury would mean that the case would have to be retried with the DA able to drop it at any point or accept a plea agreement (wanna bet on discharging a firearm in municipal limits?).

    So the game now is to delay everything since the guy is 69. He has a decade with luck of staying out of jail.  What are his odds of living to 79 or what jury would lock up a 79 yo?  Bet on this one is that once outrage dies down and case is relegated to back pages, the case is quietly dropped or there is a misdemeanor weapons plea agreement?

    Family's only real chance for justice is a civil trial.
