username - would that be the same as the whole account?

If twitter forbids the sale of accounts as part of it's TOS, than legally it couldn't be sold and thus has no value for FEC purposes.

    •  If it can't be sold ... (0+ / 0-)

... then what trumps what here?  Because the account clearly has some value.

...they just let him have the password and said "it's yours."

Then he changes the password and username and does as he wishes.

Regarding "value," it has no value to Team Romney, they don't need money for anything.

Does it have to be anymore complicated than that?

        •  It's much more complicated. (1+ / 0-)

The question for whether something is a contribution is whether it has value, not whether the giver regards it as valuable.  A billionaire giving a candidate $1000 may regard it as pocket change, but it's still a contribution.

Here's one way to think about it: if it were a Romney cache of 530K email addresses, would you think he could give it away to whoever, for free?

twitter followers are there for all to see.

Twitter followers are not like e-mail addresses.  They choose to follow, you don't solicit them.  And transferring them from one entity to another doesn't really mean anything when they followed in the first place specifically because they like Paul Ryan, and lo and behold the new "owner" of the account is......Paul Ryan.

He isn't gaining anything that I see except a simple convenience.  Now, maybe one can ascribe a monetary value to that convenience itself, but it seems pretty dubious to me.

If you transferred Barack Obama's Twitter account to me, the millions of followers would all unfollow me overnight because I'm nobody.  That's in sharp contrast to his e-mail list, which I could solicit as nauseum for whatever purpose should I obtain it.

            •  I somewhat agree (0+ / 0-)

I think a Twitter account clearly has most value to the same person, and will bleed most of its value quickly if transferred to some other entity -- much more rapidly than the transfer of an email list.  But that's not to say, therefore, that it's of no financial value and need not be accounted for in some dollar weight.
