    open question whether a court of some sort would be constitutional.  I guess if Obama doesn't sue, it may not come before the courts, but a subsequent president that may not want to be so constrained may be able to get it scrapped.

    Another idea that's been kicked around is permitting damages actions after the fact to be brought against the US by victims and their families.  That may hold more promise: proceedings would be more public and fact-specific; it's easy to imagine some sort of ex ante procedure being sorta worthless and cursory.
