          Members of the Senate don't decide constitutional issues. I don't think the federal courts want anything to do with any Congressional rules so it would now take a super majority to change the Senate rules in the 113th Congress. No Senator going nuclear would have any impact on the constitutionality of the filibuster in the Senate.

              but even that would take a majority and there is not a majority of the Senators who would support it. I doubt if you could find 40 votes, maybe not 30. It would be totally out of character for the Senate which first and foremost is a club and club members in good standing wouldn't support such a radical idea.
