The facts indicate that he slapped the toddler.

I'm for truth, and the understood meaning of "took a drunken swing" is not the same as slapping.

If he took, and landed, a "drunken swing" at a 2yr old, he would be up on murder charges right now in all likelihood.

    •  Ok, he was drunk and slapped a 2yr old while (2+ / 0-)

snarling epithets at the child's Mother. Of course he deserves a a fair hearing in court as does the Mother and the child who probably has no recollection of the event. The witnesses will swear to what they saw and heard, and it doesn't sound so good for the drunken baby brawler.

If it is proven that he slapped a baby, can we all agree that he is very dangerous drunk? I know someone who is now 61 who got caught between his brawling parents. The unintentional kick to this, then,  kids head probably wouldn't have done more than bruise an adult, but to a baby it was like getting hit with a pile driver. Smashed his jaw, knocked out his teeth, and crushed in the tooth sockets, a lifelong and periodically expensive injury.

The assaulted 2 yr old baby, in this case, has a scratch under his eye. What if Drunky McBaby Fighter had torn the kid's eyeball?

The facts do indicate he slapped a toddler. And maybe DMF thought he was slapping some sense into this whiney Mama's boy. And maybe it seemed like a justified crowd pleasing act to a drunk, but when he's convicted and his alcohol treatment program is considered into his sentencing, he should see some jail time.

    •  When we're talking about a 2-year-old, (3+ / 0-)

a slap to the head/face area is on about the same level, physiologically, as a drunken swing at an adult.

(Actually, it might be worse. Perhaps a better analogy would be a severely disabled adult.)
