    The prosecutor can try for felony charges, plea bargain to a misdemeanor, file a related misdemeanor charge, or say "Excuse me, don't you think I have better things to do?!".

    After that, a judge can choose an appropriate sentence, or say "de minimis lex non curat".

      in the leverage department. But a kind or overworked prosecutor might knock the theft down to misdemeanor criminal conversion. At this point I'm winging it based on a quick internet search, though. For all I know, there may be a prosecutor devoted to Wal-Mart enforcement!
