    These guys both represent exactly why 'loopholes' have to be slammed shut and checks have to be done.

    true, people like this will still evade the law and I make that argument; it is also true that the loopholes have to be shut - the fact bad guys will do whatever is beside the point.

      the Federal laws which govern individual private sales between a seller and a buyer who the seller has no reason to believe can not own firearms or can not buy from them due to being a resident of a different state?

      The Fourth Amendment guarantees ones personal belongings and ALL federal firearms laws that have been put in place deal directly with the Commerce Clause.  I believe it's been far too broadly interpreted.

            Remove plea bargains for crimes that use ANY weapon during its commission.  Tire iron, baseball bat or anything else.  While this would not deter crime - no laws do anything besides punish those who break them - it will force DA's to actually properly charge someone and not throw a heavier, harder to prove charge that will be pled to a lesser one.

            Create a national 'stolen guns' database that both police and owners of stolen guns can check to see if a recovered gun is one that can be returned to an owner that is not barred from firearms ownership.

            Also, open up a public facing version of the NICS that would have a 'go/no go' answer.  If 'go', then proceed.  Otherwise, go to an FFL or no dice.

            A much larger issue is the sheer number of complaints from the licensed gun brokers that go unchecked by the FBI.  In 2009, there were 71,000 NICS forms that were reported to the FBI by federal firearms licensed sellers but only 77 of them were followed up on by the FBI.  Each of the 71,000 were felonies.  Think about that for a second.

            Yes, the ATF lost their teeth while W was in office.  The FBI did not.

      should be used to rebut arguments about statistical significance.

      There are a lot of assassination threats, and a lot of potential target so "statistically" extremely few successful assassination attempts.

      Yet we still seek to immediately restrict rights when an assassination threat is combined with something else reflecting enhanced capability, enhanced commitment, or impaired judgment, such as attempting to unlawfully access the White House, or drunken face book posting hit lists, or amassing a small arsenal.
