  •  Justice Kennedy has been pro-equality (10+ / 0-)

Writing the opinions of the Court in Romer (striking down a Colorado amendment restricting LGBT efforts to seek civil rights protections) and Lawrence (striking down state bans on sodomy).  There's at least five votes on our side.

I'm not really going on a paper trail here, just a hunch, but I think the Chief Justice will be with the good guys here on both cases.

And I think it's especially short-sighted of the Prop 8 intervenors to put all their eggs in the "it's all about procreation" basket. Could they be any more disrespectful to the CJ's own family structure?

As Olsen & Bois put it in their brief, the Prop 8 intervenors “have imagined a cramped definition of marriage as a utilitarian incentive devised by and put into service by the state — society’s way of channeling heterosexual potential parents into ‘responsible procreation.’  In their 65-page brief about marriage in California, proponents do not even mention the word ‘love.’”

That is good news, and I appreciate hearing some actual case names to get me started in my research! Thanks!

I would tip you, but the man took away my tips.
