  •  a constitutional crisis - nobody notices (13+ / 0-)

Glenn Greenwald, the civil rights attorney and now journalist has an excellent column on this decision.

    Here is the last paragraph.

When the new 2008 FISA eavesdropping law was passed, all sorts of legal scholars debated its constitutionality, but it turns out that debate was - like the Constitution itself - completely academic. As both the Bush and Obama administrations have repeatedly proven, they are free to violate the Constitution at will just so long as they do so with enough secrecy to convince subservient federal courts to bar everyone from challenging their conduct.
did you see that, the constitution itself is completely academic

30 years of right wing judges and 30 years of right wing republicans along with complicity of the democrats and we have a constitutional crisis

this is a real crisis, not the fiscal cliff that will be used as a shock doctrine to reduce SS, medicare and medicade

we really do need a main stream media to inform the public rather than the corporate media which is part of the corporate coup d'etat

and was explicitly singled out by our Founders as one of the excesses they were trying to stop. Seems that a subservience to the "big brother" aspect of government is built into the psyche of so many of those who are in the higher courts.

all of the actors involved are playing along rather than playing their role. There's no question that we have an existential crisis playing out just beneath the surface. But the explicit and implicit agreement between the three branches leaves no way for that crisis to play out within the bounds of our Constitutional system, which relies on each branch playing an adversarial role against the other two.

Meaning this crisis and those related to it will eventually be forced to play out beyond the boundaries of our politics, where peaceful debate is far from guaranteed.

There is no remedy for violating the Constitution, other than impeachment, and this President will never be removed at trial in this Senate.  So, Constitution, Schmonstitution.
