    They can also solve the problem by requiring that every district in every state get preclearance. Equal treatment solved.

    After all, if there is no injury then where is the harm?

      but PA is (a) where I'm from, (b) is heavily gerrymandered, and (c) passed an asshole photo ID law.

      I think requiring every jurisdiction to get preclearance would be extremely burdensome, given the myriad election decisions made at the county level, and so a standard that says there has to be a history of state-sponsored discrimination and that Congress can decide that is fair.  However, I don't think the actions of Richard J. Daley can possibly exculpate Shelby County, Alabama, which is practically antebellum.
