    I'm split about 50/50 on what happens here. I think Roberts probably wants to gut it personally, but like you say, he does care about his legacy, and I sure would not want it contaminated with Scalia's truly foul attitude. We shall see when thet deliver the decision.

      a side they might not personally agree with in order to exercise their prerogative (as senior Justice on the majority side) of choosing who gets to write the opinion (including themselves).

      After the Obamacare decision, I'm not likely to make any assumptions with Roberts
