I somewhat disagree with this line of thinking; it's too similar to the argument Scalia made from the bench regarding the Voting Rights Act ("the obvious answer is no" being a proper answer simply for being politically correct).

You can still make the case that certain infringements are necessary, and an emotionally powerful one.  You do so by pointing out obvious, everyday exceptions.  The more heinous, the better.  What's a more interesting story?  Feinstein says there are limits on constitutional rights or Ted Cruz defending child pornography?

I usually don't favor those kind of arguments for the same reason DiFi took Cruz to task; they question the integrity and intelligence of your opponent.  But in this case, Cruz invited such a response by dumbing down the discussion to a sixth grade level.  I'm half convinced Cruz and the NRA are in Bloomberg's pay to throw the game for gun owners.

    •  He rattled her and that's apparently what he does. (3+ / 0-)

We all know the calm antagonist who makes emotionless insults and doubles down as their target becomes agitated by it. It's a disgusting personality trait.

Anywho. Durbin gave a sober response with out saying yes or no. I guess there's a yes or no answer to the question as Cruz posed it and then there's an answer to a reasonable question.

She didn't seem rattled.  I got the impression it was the other way around, and Cruz's retort was weak.  I'm not saying jumping to the "child pornography" line was the most obvious thing to do.

If I were Cruz, I would have asked an entirely different question.  "What's the difference between the Mini-14 you would ban and the Mini-14 you would exempt?  They both accept the same magazines.  They both fire .223 ammunition.  They're both semi-automatic."

and Feinstein was not prepared to be rattled.  She can hold her own and will get another chance, of that I'm certain.

Cruz was framing a false equivalency legal argument, something he is trained to do.
