  •  There's a couple of diaries here (4+ / 0-)

That reveal parts of her identity and provide links that identify the rest.

And there are people here who believe it's fair game to publish the names of the teenagers who are sending out the hate messages because the names have been published elsewhere. Even Faux Noise redacted these names.

    Sad.

    When emotions override decency.

    Sad.

        I rest my case.

You've got a lot of work to do. There has to be millions of 15 year old girls whose names you should expose on the Internet for writing or saying something stupid and offensive.

Oh, and you'll need to publish the names of the boys who were found delinquent for committing this tragic crime. And everyone who witnessed this crime.

Cuz it's fair game for adults to pile on and bully teenagers who say stupid things. Expose this to the entire world!

As long as they're not a victim. Cuz that's different.

        •  really? (0+ / 0-)

if a teenager threatened your life, you'd worry about his privacy?

          •  By law, juvenile's names are confidential (0+ / 0-)

unless they're charged as adults or commit an equivalent adult felony.

Threatening is a class 3 or 4 misdemeanor in Ohio. Criminal threatening is entirely different. A gun or a knife. There's probably a dozen different laws that might apply to various threats.

Also, if a teenager threatened my life, I would sure the hell know his name but there's no way I would ever violate his privacy. It might be a technical point that lets him walk free for one reason.

You bet, I'd protect his privacy.

I've been involved in a full-on felony jury trial of a sexual predator whose intended victim was my wife. I will never reveal his name. He's back in prison for the 4th time, btw. Our trial was his 3rd conviction.

So yeah. You don't want this kind of experience. But I can assure you that it would change your whole outlook, in detail, about our criminal justice system.

            •  confidentially applies to the system (0+ / 0-)

not sure how gagging the victim with respect to events that occurred outside the legal system can be remotely constitutional.

              •  That's where ethics and decency applies (0+ / 0-)

Assume it's you when you were 15.
Or your child, grandchild, niece, neighbor,, etc.

Apparently, that's a reach for a few people. IMO, it's a symptom of a possible personality disorder. No concept of empathy. Sad.

If there is a shred of empathy, then it's a bad thing when  thousands of strangers reveal the child's identity because they fervently want to be sure that everyone knows to point to this child as an example of a stupid kid who said a stupid and mean thing. Once. Just once.

Kids have killed themselves for less bullying than that.

And it's not about gagging the victim. It's about strangers who feel it's ok to reveal the name of a juvenile in multiple worldwide public forums.

And it's not isolated to a specific community. Yet that's a commonly cited argument as absurd as that is.

And it also happens to be illegal in certain circumstances in Ohio and everywhere else. There's a reason for that. But a few people can't question their beliefs. It's a personal threat if they think, apparently.

                •  I don't understand (0+ / 0-)

If I videotape somebody threatening me, I have an absolute right to show the video to anyone and everyone I feel like.  If somebody gets butthurt over this, that's their fucking tough luck.

You seem to think that the preferences of some entity that calls itself the State of Ohio, or whatever the fuck it chooses to call itself, should trump my fundamental rights.  Fuck it and fuck everyone who feels that way.

Oh, and if fewer children were shielded from the consequences of their actions at the ages of eight and nine, fewer would be destroying other people's lives as teenagers in ways that might be mildly inconvenient to themselves in later decades.  Yeah, I'm really lacking in empathy today.
