      the retailer does NOT get the money! The state and city does. They decide the amount and tell the stores to collect and the stores send it to them. Why would anyone ever file a class action suit against sales tax? What possible chance of winning would they have? Are you freaking out of your mind? Get a grip! REad what you are writing!!!!!

        ...only get 8.75%, with the store pocketing the rounding error that got it up to the nearest nickel. The class-action suit would be against the retailer, not the state.
