    Olson and Boies have consistently argued that Prop. 8's proponents had no standing to appeal the district court's decision, and that only the defendants (the Governor and AG) had the right to appeal.  They didn't, so case closed.

    The Ninth Circuit disagreed, held it had standing, then addressed the merits.

    The Supreme Court could decide there is no standing, and not reach the merits.
