You don't have an answer to the poster's very cogent question.

You think rape is a 'special crime'... that should not be held to the same evidentiary standards as other crimes? Or, because of your somewhat irrational belief that because it is hard to file a true rape charge, it must also be hard to file a false one?

Do you believe that the accused has a right to confront their accuser (in an adversarial manner)? Do you believe that everyone including accused rapists deserves a zealous defense before an impartial judge and jury? I'm hoping for an unqualified "yes" answer to these questions.

      What. A. Suprise.

Why are you so unconcerned with false accusations towards any other kind of criminal yet have so much heat on the need to defend rapists vigorously?

      Quite a conundrum, really.

... rape accusation was made. I have yet to hear of any proof. Is a rape accusation all the proof you need?

If the alleged rapist is, in fact, innocent, then perhaps you have committed defamation? How hard is it to put the word "alleged" in front of the word "rapist"?

If the rapist is, in fact, guilty, then throw him in prison for life. But we're a society of laws and courts and proofs.

I would tip you, but the man took away my tips.

        •  That is not my point at all (0+ / 0-)

My point is we have a user on DK who defends every single rapist in every single rape diary that he posts in.  And I have a problem with THAT.

I am not familiar on the issues in this case and that is why I haven't spoken to them at all.

    •  actually I believe entlord's point (0+ / 0-)

was the opposite of your claim that he would change the rules of evidenc.,  The point was that with rape the rules have already been changed, so that a victim frequently has to prove innocence before proof against the alleged rapist will even be considered.  Things like 'She asked for it, was dressed like a whore, went to a bar,  was in a bad neighborhood,   was sexually active so of course she said yes this time too' comments from police, judges, etc have been diaried in just the last year or so here.  Frankly, I think entlord's point was very well taken about the prosecution of rape cases being special.    And not in a good way.

      •  thank you for making the point I was attempting (1+ / 0-)

at times I may appear obtuse or confused so I welcome any assistance in presenting my POV; OTOH I also think some people choose to misunderstand and misinterpret what i am trying to say
