    1. What nowhere man said. They're banking on the conservative 5 in DC, who are pretty good at coming up with tortured rationales for conservative shit. Why accept a loss rather than try to appeal?

    2. They do not see their justifications being "only religious" as meaning they're not valid "legal" justifications. These are people who think law and religion should largely overlap.

      Because there's a difference between "should" and "do".  The fact is, for the most part, law and religion do not overlap in this country, whether one thinks they should or not.  Any lawyer worth the money they're being paid would be able to tell you that.

        See # 1 above. They had the highly-credentialed lawyers who made the arguments they made the last couple of days. If they're losing arguments, so be it. There are losing arguments made in every case. Why would they not appeal and at least give it a go? To them the sky is falling.
