      Isn't sexual preference "sex?" IANAL but I would think if we had an ERA that it might be part of the supporting argument here.

        Is sex gender?

          The way I learned it, people have a sex (either male or female or, I suppose, something that is transitioning). "Gender" on the other hand is a grammatical construct to describe nouns and adjectives in languages like French or German or Latin. Latin and German also have a neuter gender. Some languages have many different genders for nouns and adjectives (but they end up being called category 1, 2, 3, 4, etc.).

          But Americans seem to dislike the word "sex" so they change it to "gender." My sex is male. I don't have a gender (because I'm not a word).
