Someone mentioned the problems with trying to transfer a couple from a Legal-State to an Ban-State because their rights under DOMA would change.

My recollection is that my brother, who was in the Air Force, decided to make Texas his domicile after being stationed there for training. He liked their no-income-tax rules. He kept Texas as his domicile as he moved from state to state, and then abroad, and then back, until retiring.

How does it work with DOMA?

What if both the military member of the couple and the spouse were to declare that Massachusetts, say, is their domicile?

I'm just curious about this, because I sincerely hope that the Supreme Court will rectify the situation for all, soon.
