    The Catholic Church still officially rationalizes the procedures of the Spanish Inquisition because without it, inquiries into heresy would have been excessively localized, nonuniform, and subject to abuse.  Including the Comfy Chair.

      The argument really has no more to it than Mussolini made the trains run on time.  It really is disgraceful that the time of the United States Supreme Court must be taken up with this drivel.

      More interesting is Scalia's refrain of "exactly when did this right come into existence?"  Scalia does that a lot.  Olsen crossed swords with Scalia, telling him courteously that to require a date-of-creation for a right was no part of a court's business.  A lesser attorney would have fallen into the trap and tried to answer the question.

      If anybody reading this should have a proper education in both law and philosophy, there is no doubt an essay to be written concerning Scalia's ploy.
