private sales and the required background checks are actually conducted.  If so and so sells a gun in his living room, who would know?

    If they get caught.....

"I sold it to him, the day before the requirement"  No one could ever prove otherwise.

    •  yes. There will be some people who do this... (6+ / 0-)

...since some people break laws, whatever the laws are. But most gun owners (as we are daily reminded here at DKos and elsewhere) are law-abiding citizens, the vast majority of private sales will be handled legally. Of course, because this proposal will not stop some breaking of the law, we will be told that it "won't work."

Why is it that we don't hear that because some corporations continue to violate safety regulations imposed by the law or some individuals continue to commit rape we should get rid of eco-laws and laws against sexual assault, but that it is perfectly reasonable not to have laws requiring background checks for gun buys because some people will cheat?

have a problem's the lack of target of the criminals that bugs me.

Rape laws apply to rapists.  If you rape someone, you go to prison.

If safety laws are broken, fines are applied...jail time if severe enough.

Drunk driving laws apply only to drunk drivers.  We don't take away all cars and ban all driving because sober people might drink one day.  We put drunk drivers in prison.

We already ignore gun laws.... we already allow people to fail a background check and nothing happens to them. We already let people off who actually hurt people with guns and let them out early etc.

Perhaps the sane thing to do BEFORE we add more laws against law abiding gun to actually prosecute those who break the law already. Make it real, enforce them and then if that doesn't work....then maybe target the law abiding.  (or take cars away from sober people)

the NRA or GOA to stop working so diligently to get the ATF's and FBI's budget boosted if you want gun laws enforced better.

As for letting people out early, I am sure there are some instances. Perhaps if we changed the drug laws, there would be enough space for violent criminals. EVERY state and the Feds have lengthy, mandatory sentence enhancements in place if a gun is added to the mix when other crimes are committed. I am all for seeing those enforced to their maximum. They handled strictly in California, but then gun-rights advocates are plenty unhappy with most California gun laws.
