    because the Senate wouldn't approve even one of Obama's nominations? One nominee just removed herself because it's been waiting 4 years. Meanwhile that court has had a majority of con judges who have religiously ruled in favor of the 1%. This is probably the 1% of their decisions that wasn't.

    I think it is only coincidence that this sort of reinforces the comment by Roberts (or Scalia ?) that the president and Congress could be making some of these constitutional decisions and acting on their own. Which brought impeachment to my mind in a few nanoseconds.

      in the last month or so saying exactly that......no Obama appointees have yet made it to the DC Circuit.  

      And you can be sure that is exactly occurring by design of the the top Republican leaders in the Senate.

          book that I recommend for all advocates to help improve their advocacy writing.    "A practical guide to legal writing & legal method" by John C. Dernbach.

          It is in use at a large chunk of law schools in the U.S. so you might be able to find it in bookstores or on Amazon.

          My friend John Dernbach is a Professor of Law at Widener and was the lead author of the Amicus Brief of the Climate Scientists before the Supreme Court in the original Massachusetts case in which the Supreme Court determined that the Federal Clean Air Act authorized EPA to regulated carbon dioxide as a greenhouse gas.
