it can always pass on the lawsuit losses to future customers.

the PR nightmare will cost that hospital and its board and shareholders.

A PR campaign (and a report to JCAHO or whoever their certifying authority is, stat) needs to start posthaste.

Federal Officials Aim For “Speedy” Response Following Missouri Hospital Arrest [Emphasis added]

WASHINGTON — Federal officials are "aware" of the Missouri hospital that had a man arrested for refusing to leave the bedside of his partner, and "are working to gather the facts and determine what steps to take in a speedy manner," a Medicare/Medicaid spokesman said Thursday afternoon.

At President Obama's direction during his first term, Health and Human Services Secretary Kathleen Sebelius issued regulations mandating that hospitals that receive Medicaid or Medicare funds allow patients the right to have visitors of their choosing, regardless of sexual orientation.

Centers for Medicare & Medicaid Services (CMS), which enforces the regulations through coordination with the states, is looking into the situation. CMS spokesman Brian Cook told BuzzFeed Thursday afternoon,

        Go Brian.

by the sound of it.  It's not ONLY the hospital that is at fault here, but the local cops who assisted the abusive brother, their fellow cop,  in overriding the wishes of the patient, the patient's spouse, and his spouse's daughter a trusted caregiver.  They made no effort to assess the situation independently of their crony's report, and indeed were strenuous in ignoring any possiblity that their crony might be the problem not the solution.

The brother being an asshole was definitely the root cause of this situation, but his fellow cops AND the entire hospital totally enabled him.

They should ALL face legal jeopardy.

Oh, and always buy trip insurance.  It probably would have cost $100 or so.  There's many things it fails to cover, but it DOES pay for nonrefundable flights and hotels if you or a near family member are hospitalized.

Not sure who has the jurisdiction, etc. to investigate. The whole scene Amanda described at the house when they got home stunk worse than a tar sands spill.

The idea that Allen could be described as a danger to himself is just ludicrous. The cops and his brother had a plan and they carried it out. They are very familiar with putting people in enough stress to incapacitate their mental function so they go along with the plan.

While health care people are certainly familiar with situations where patients are being abused, etc by caregivers, spouses and others, we see just as much of this kind of inappropriate interference by family members. It's like walking into a gunfight and not knowing who are the good and bad guys. You have to shut down preconceptions and get people to talk. Listen, check records, etc. Be a little prepared for the nicest ones to be  manipulators and abusers, while the real caregivers or defenders are the most distraught.

The initial stupidity with the cops was bad enough. What adds to it exponentially is the way the RN reacted. This kind of ugly and potentially dangerous behavior by family or visitors is not uncommon in hospitals. The security staff is trained much better than the cops to DE escalate. Do it all the time. Gives the staff breathing room to check records, assess, get meds, etc. For the RN to skip an overhead emergency page to the security team ("Dr Quick, room 503" - 1-2 min max) and call the local cops (5 to 10 + minutes) is just too suspicious.

My suspicion on the brother cop, who apparently has some homophobic stuff on his FB page, is that he has convinced himself Allen's chronic depression problems are due to being gay. So he had to 'rescue' him from that relationship. He probably will never accept that straight people also can have chronic, unrelenting, untreatable depression.

If nothing else, I hope Allen can get a restraining order on the brother and sister. I also hope they can get out of their insurance company paying for the ambulance or hospitalization. That might be the best place to get some justice, sic the insurance tightwads on the perps. ; )
