    The man was not prosecuted nor was he arrested. There were no charges brought so in this case, it will be his responsibility to pay for the lawyer/

        and in this case there is not much recourse especially with governmental immunity for the discretionary acts of the clerk of Erie County.  But yes you can sue and waste more money and resources.
