    You are 100% correct - I predict that later this term the Supreme Court will hold that a class arbitration is always improper unless the words "we can have a class arbitration" are set forth in the agreement.  This, coupled with a ruling regarding antitrust law and class actions/arbitrations, will render it virtually impossible for anyone with an arbitration clause to obtain class relief.  As Scalia said at oral argument (I am paraphrasing) - "If they only steal a little at a time from you, the law gives you no remedy.  Sorry."

      ... remedies away by inches or bludgeons a result with the will of its sorry majority, the result is legislation from the bench, the very ill those allegedly conservative justices bluster against.
