    Your ex-wife agrees that it is OK for you to visit, take the girls for an outing, and so on, whenever you have the time and inclination, subject to you calling in advance, which I'm sure you always do, and subject to prior plans, which I'm sure can also be negotiated to a certain extent.
    The fact that your visits can be a spur of the moment, flexible, catch as catch can arrangement does not mean it is not an agreement. Sure, it's not your typical lawyer written you get Christmas she gets Easter kind of agreement, but it is still something she agrees to allow to happen.
    You are certainly correct in thinking that your agreement about visits is best for your girls, but I think you are mistaken in believing you have retained some sort of parental right (assuming she has custody.)

      but we have joint legal. And she would have consented to joint physical if it had been doable (it wasn't from my end).
