    If federal charges are brought, he'll be tried in a federal court in Massachusetts. Federal law, including the availability of the death penalty, will apply. That doesn't mean it will be sought or given, but it will definitely be available.

    The feds could decide, if there is not sufficient evidence of motive to support a terrorism charge, to leave the murder and other prosecutions to the state (in which case, no DP). Or they could decide to pursue him in federal court on other federal charges, e.g., those relating to explosives.
