      I can understand the rationale for national security in this case.

      However, we all know this rule is in grave danger to be abused.

      Tough balance between value of life and value of civil rights.

      Hard stuff. The key is certainly that the DOJ has to justify the use of that rule in each and every case. No secret. Total transparency. Some strong system of accountability.
      And some way to stop an administration that would abuse the rule.

      Folks: next elections, think Supreme Court. Just saying.

        The Richard Allen Davis case in California included a ruling that more or less suggests there's no time limit to the Quarles public safety exception.

        But this is a pretty hard rule to abuse. It applies when the suspect possesses information that is necessary to protect public safety. The courts have always construed this as an objective test, not a subjective one -- no rules-lawyering about "public safety", it means here what you think it ought to mean.

        It's hard to imagine a case where Quarles is more applicable than here. Are there other bombers? Are there other bombs out there? It's challenging to think that there could be questions more applicable to public safety than these.
