    All I want is for the accused to receive a fair trial.

    Any information gained prior to being mirandized is subject to being thrown out by the courts unless the prosecution can prove an overriding public need for safety is in play.  Even then the court can throw out any admissions prior to miranda.

        and I don't see the miranda issue as falling into the dark ages.

        Miranda rights are yours whether someone reads them to you or not.  Failure to mirandize means that anything the accused says is inadmissable in court.

        The only exception granted by the supreme court was immediate public safety.

        In my mind, delay in mirandizing the suspect can either be good for public safety or imperil the court case, but I don't see the nexus with torture.

        •  I don't think Horace was referring to Miranda (0+ / 0-)

          when he mentioned the Magna Carta. I would guess he was referring to that quaint but obsolete principle of habeas corpus, which has been and is being so well respected at Guantanamo and other sites.

      I'm glad you have so much faith in those who administer the justice system in your and all our names. Until 2001, I too had that faith. Now, not so much.
