    It is not either/or.

    However, states determine marriage laws, not Congress. Overturning DOMA is about precisely that, while the pending Perry v. Hollingsworth decision is considered unlikely to result in a Loving-esque strike-down of all laws against marriage equality.

    So for now, the work continues on the state level.
