      ...that you are referring to the fact that background checks are not currently legally necessary for sales or transfers between private buyers, i.e., non-licensed dealers.

      This has nothing to do with gun shows, where, to the best of my knowledge, all other federal and state laws are fully applicable.

      I only bring this up because it appeared as if you might not be aware of that fact, from the wording of your post.  If I have mis-read what you were trying to say, I sincerely apologize.  Text-based discussion are often lacking that way.

      At issue is whether or not private individuals, not FFLs, not licensed dealers at gun shows, may perform transactions and under what circumstances.  This is an issue that is embedded up to it's elbows in state law with a myriad of variations.  

      It is also problematic that misinformation and fear drive the issue.  Contrary to the belief of some, it is not true that someone can just declare something a "private sale" and instantly no BC is required.

      It is much like the so called Internet Sale Loophole where everyone points to the SELLER not performing a BC but fails to mention the seller is not the party responsible for the BC which happens on the receiving end.
